Tick respects copyright and expects its users to. This policy is part of our Terms of Service. It explains what you may upload, how rights holders can ask us to remove material, and how users can respond.

1. Upload only what you own or are licensed to use

You may upload only material you created, or that you have permission to use on Tick. That includes every part of a video: the footage, the music and any other sound. Music you added in TikTok, Instagram, CapCut or another app is licensed for use inside that app, not on Tick. A clip being short, credited, or edited does not by itself make it lawful to use.

If a trade card video has music you are not licensed to use, mute the audio before exporting, or choose a clip without it.

2. Where to send a notice

3. Notice of claimed infringement

If you believe material on Tick infringes a copyright you own or act for, send our agent a written notice that includes:

  1. your physical or electronic signature, as the owner or a person authorized to act for the owner;
  2. identification of the copyrighted work you say is infringed (or, for several works, a representative list);
  3. identification of the material you say is infringing, with enough information for us to find it, such as its link on Tick;
  4. your name, address, telephone number and email address;
  5. a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the right that is allegedly infringed.

When we receive a complete notice we will remove or disable access to the material promptly and tell the user who posted it, including a copy of the notice. If a notice is incomplete but identifies the work, the material and how to contact you, we will try to contact you to complete it.

4. Counter-notice

If material you posted was removed and you believe it was removed by mistake or misidentification, you can send our agent a counter-notice that includes:

  1. your physical or electronic signature;
  2. identification of the material that was removed and where it appeared before removal;
  3. a statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which Tick may be found), and that you will accept service of process from the person who sent the original notice or their agent.

We will send a copy of your counter-notice to the person who sent the original notice and tell them we will restore the material in 10 business days. We will restore it no sooner than 10 and no later than 14 business days after we receive the counter-notice, unless our agent first receives notice that they have filed a court action seeking to restrain you from the infringing activity.

5. False notices

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and lawyers' fees. If you are unsure whether material infringes, consider getting legal advice before sending a notice.

6. Repeat infringers

Tick terminates, in appropriate circumstances, the accounts of users who repeatedly infringe copyright. As a rule, an account that receives three valid notices within twelve months, not successfully countered, will be closed, and we may close an account sooner for a clear or serious infringement. We may also remove material or close accounts for infringement without a notice.

For complaints about trademarks, privacy or other rights that are not copyright, email matteo@tick.so with enough detail for us to review the material.
